Attorney's fee

How is the attorney's fee determined?

THE AMOUNT OF THE ATTORNEY'S FEE

You will find full information about the service packages we offer businesses by clicking this link. Before quoting we offer a free 30-minute consultation so that we can understand the type and scope of the work involved.

Formation of a Kft. (limited liability company) or Bt. (limited partnership): HUF 150,000 + VAT under the simplified procedure

Formation of a Zrt. (private company limited by shares): HUF 200,000 + VAT under the simplified procedure

For a bespoke constitutive document or a contribution in kind we provide a separate quote.

Corporate changes: the fee depends on the time the change requires; the minimum is HUF 100,000 + VAT

Up to a market value of HUF 30 million: a fixed HUF 150,000 + VAT (minimum fee)

Up to a market value of HUF 100 million: 0.5% + VAT

Between HUF 100 million and HUF 200 million market value: 0.4% + VAT

Between HUF 200 million and HUF 300 million market value: 0.3% + VAT

Above HUF 300 million market value: a fixed HUF 1,000,000 + VAT

Our property fee calculator, which also includes costs, is available by clicking this link.

HUF 45,000 + VAT per hour commenced.

HUF 45,000 + VAT per hour commenced, with the fee for the first consultation credited against later fees.

The fee for litigation depends greatly on the type of case and the facts. Where the nature of the case does not allow the statutory rate to serve as the basis of the fee, our rates are as follows:

Base fee covering the statement of claim or defence, the consultation needed to prepare it and the time required for filing with the court: from HUF 300,000 + VAT

Litigation hourly rate: HUF 45,000 + VAT per hour commenced

Our calculator for the statutory value-based attorney’s fee is available by clicking this link.

We only apply a success fee alongside a base fee: the fee set as the base fee (whether fixed or hourly) is charged even if the proceedings are unsuccessful, while a successful outcome adds the success fee on top. Its amount is set individually depending on the case, so we cannot give advance information about success fees here.

We do not take on engagements on a success-fee-only basis.

We provide free legal representation only to the non-profit organisation(s) we have chosen to support; we do not offer it to private individuals, companies, local authorities or other market participants.

In accordance with point 10.6/B f) of the Hungarian Bar Association’s rules on the ethics of the legal profession (6/2018. (III. 26.) MÜK), we inform you that an engagement contract may not depart, to the client’s disadvantage, from the fee information published on this website at the time the contract is concluded. The above is for information only and does not constitute a direct or indirect offer. The amounts shown relate solely to the attorney’s fee and do not include the costs of handling individual matters, official or procedural charges, or out-of-pocket expenses. A detailed and precise quote covering the fee and the expected costs can only be given by e-mail or in person once we know the full facts.

The attorney's fee at Dr. Andirkó Law Firm

At Dr. Andirkó Law Firm a long-term, fair partnership is the highest value, so we offer cost-effective solutions to every client. We do not talk clients into solutions that bring unnecessary expense, and we tell them when in our judgement the outcome is unlikely to be favourable and the matter is not worth pursuing.

We always give clients detailed, transparent information before the engagement contract is signed and while it is being performed. Alongside the expected time commitment and the precise fee, we also explain any other costs that may arise – administrative service charges or procedural duties (illeték), for example.

There are no hidden costs, so you need not worry about unexpected expenses arising during the procedure.

Our firm is VAT-registered, so VAT is added to the fees.

Types of attorney's fee

Flat fee

A lawyer providing a comprehensive legal service has to offer businesses up-to-date knowledge across many fields. That is what keeps operations running smoothly and business dealings secure. Our aim is to minimise risk and optimise the company’s costs.

Large companies can maintain in-house legal departments; in the SME sector there is often neither the need nor the budget for that. But it does not mean small and medium-sized enterprises have to do without ongoing legal representation.

We have made it our mission to make ongoing legal representation available to small and medium-sized enterprises as well as to large companies, so our monthly-fee legal service is available for a fraction of the full employment cost of an in-house counsel.

Under ongoing engagements the work (whether legal representation, drafting documents, advice or corporate changes) and our availability are provided continuously for a flat monthly fee. The monthly fee is set in advance on the basis of the tasks arising and the expected availability required.

Its advantages:

Flat-fee engagements are typically not confined to a single field of law, since many different questions can arise in the life of a business. For example:

Itemised or value-based fee

We typically apply this in case types where the time required and the responsibility our firm assumes can be determined in advance. Typical examples are company formation, corporate changes, and property document drafting requiring a lawyer’s countersignature.

By countersigning, the lawyer takes responsibility – backed by their mandatory professional indemnity insurance, in the case of a law firm primarily by the firm’s assets and secondarily (or, for a sole practitioner, directly) by their own personal assets – that the countersigned document complies in form and content with the applicable law and with the parties’ intentions. For that responsibility and for the standard of our service we set a fee proportionate to the value.

Attorney's fee for company proceedings

This does not necessarily mean the case type is fixed-price, since registering a corporate change often involves more work than forming the company itself. Nor is it irrelevant how far-reaching the changes to be recorded at the company court are.

Even the simplest company proceeding requires the following steps:

Attorney's fee for property matters

For property document drafting – a sale or gift contract, for example – we typically work with a percentage fee based on the purchase price. This cannot be applied in every case, however.

Handling the sale of an empty plot worth a few hundred thousand forints takes the lawyer just as much time as a family house worth over a hundred million paid in one sum.

In the former case our percentage rate would produce a fee of a few thousand forints, which is of course not realistic, so for low-value property transactions we work to a set minimum fee. We set that fee according to the minimum time even the simplest property matter takes, because the work is not confined to drafting the contract.

In the second case, while handling the matter genuinely does not take more hours, the high purchase price means the lawyer’s responsibility is greater – and that has to be reflected in the fee.

It is a misconception that drafting documents is simply routine, and we readily admit we would like to change that mistaken picture. Many underestimate the lawyer’s work here, because preparing the contract is only one part of the whole process.

There is no such thing as routine work– every case has its own particularities. We aim to answer every question in detail and, perhaps more importantly, in language the client can understand.

From the experience of several hundred property transactions we can say that concluding the contract must in every case include the following:

Besides the value of the matter and the time spent, the particularities of the transaction can also affect the drafting fee. For example, it also matters whether

That is precisely why the calculator above is for guidance only as towhat the fee for a contract will be. We always examine the particularities of the transaction together with the client. Once we know the details, we give a detailed quote covering both the fee and the expected costs. And we always optimise the transfer duty (illeték) at no additional charge.

Standard hourly rate

We most often bill by the hour for legal advice and for litigation.

If you go on to instruct us, the first consultation is credited against later fees. This means that if you sign an engagement contract with us on that first occasion for the matter concerned, the consultation is not charged separately. And if, after a chargeable consultation, you later decide to instruct us to represent you, the earlier fee is credited in full against the later fee. For example, you book a consultation about litigation and a week later decide to start proceedings with our help.

Attorney's fee for legal advice

We bill legal advice per hour commenced. General one-off advice rarely runs beyond that; in our experience an hour’s consultation is enough to review a matter in detail. We therefore book clients in for an hour by default, so there is certainly time to answer every question that comes up. If the consultation takes less time, we still charge for the full hour.

One-off legal advice is always chargeable. We can only give sound legal advice knowing the facts and the documents in the matter. A consultation can take place online via Zoom, Google Meet, Teams or FaceTime, so we can be sure of finding a platform that suits everyone. In-person consultations are primarily available at our Debrecen or Hajdúböszörmény offices.

We are unfortunately not able to answer questions put by phone, Messenger or e-mail without an engagement. Without knowing the facts and the documents we do not want to give misleading information for which we cannot take responsibility.

Attorney's fee for litigation

We also apply the hourly rate where the amount of work needed cannot be determined in advance. Court proceedings are the typical example.

We divide litigation into two stages: the written stage preceding courtroom representation, and the courtroom stage, which begins after the summons. We generally align the fee with this, combining a base fee and an hourly rate:

While the value of the matter is a key question in setting the fee in litigation, assessing the complexity of the case is even more important. A case with a huge amount at stake can be straightforward, while a low-value case can be particularly complex – the facts matter greatly here.

Transparency and cost-effectiveness are among our firm’s core values, and we believe they matter most when accounting to clients. We use second-based time-tracking software, and clients can check in the resulting report at any time when and how much time we spent on each part of the matter.

Again from experience, we can say why we do not consider a fee fixed for the whole of a litigation appropriate: either the client or the lawyer ends up worse off financially. If a high fixed fee is agreed and the matter is settled quickly, the client may well feel they paid a great deal for what looks like little work. If, on the other hand, the matter drags on for years because of unforeseeable circumstances, the lawyer has done a great deal of work at a loss. That is why we believe that in litigation an hourly rate is the most transparent arrangement: the client pays only for the hours actually spent on the matter.

Success fee

Legal practice is an obligation of means, not of result. This means that the lawyer does not undertake to deliver a particular outcome (it would be irresponsible to guarantee winning a case), but to handle the matter to the best of their knowledge and with due care.

A success fee may be considered where the matter carries a higher risk factor justifying a higher fee if the outcome is positive. The engagement contract always sets out in detail what counts as success – winning a case, or successfully reducing the amount of a claim against the client, are the clearest examples.

We only apply a success fee alongside a base fee: the fee set as the base fee (whether fixed or hourly) is charged even if the proceedings are unsuccessful, while a successful outcome adds the success fee on top.

We therefore do not take on engagements on a success-fee-only basis.

Free legal representation

Free legal representation and legal services are not available at our firm. That does not mean we do not work wholeheartedly for our community.

Becoming a lawyer is preceded by roughly ten years of study from the start of law school, and as a Debrecen firm we think it important to support a local non-profit dedicated to teaching and mentoring disadvantaged children. In the spirit of social responsibility, our pro bono legal service, provided since 2023, supports the work of Láthatatlan Iskola (Invisible School).

If your means are limited, you can turn to the legal aid service for your place of residence or stay, where lawyers on the official register provide advice or take on legal representation. The contact details of the Hajdú-Bihar County legal aid service are:

Attorney's fees: what causes the differences in price?

The market offers many different legal services, so both those for whom low fees are the priority and those who need the expertise and experience of an international firm can find a lawyer that fits.

As with any other service, it is true of legal fees that a higher price usually buys a better service and greater added value. A lawyer’s fee depends on several factors: the complexity and value of the matter, the responsibility the lawyer assumes, and the time spent are all decisive.

Prices can differ between law firms as follows:

Attorney's fees: general information

The attorney’s fee is a matter of free agreement between lawyer and client. In certain areas – property transactions, company proceedings or higher-level litigation, for example – the law requires legal representation, so a lawyer’s involvement is essential. Beyond those, there are many situations where expert legal advice saves time or visible costs if the client turns to a lawyer at the right moment.

Unlike the statutory fee calculation prescribed for notaries, there is no binding statute or bar association recommendation for calculating attorney’s fees – with the exception of the decree on legal costs awardable in court proceedings, which merely provides a reference point for litigation fees.

FREQUENTLY ASKED QUESTIONS

Consultations and advice are always chargeable, but the consultation fee is credited against later fees. Free advice is not available, and we cannot answer one-off questions by phone, e-mail or Messenger without knowing the facts and the documents, since we cannot take responsibility for advice given without knowing the details.

We can issue an invoice for payment in cash or by bank transfer, plus VAT.

The fee covers only the legal service; it does not include other charges, costs or out-of-pocket expenses – land registry fees and the cost of title deeds, court duties (illeték) or travel costs, for example. No hidden costs can arise: we explain the expected costs before the engagement contract is signed and set them out in the contract as well.

Where we apply an hourly rate, we record it per hour commenced, as is customary in the market. Under monthly-fee engagements we contract for a block of hours, and use of that block is recorded by the minute.

Under the flat-fee arrangement the business receives a continuous legal service for a fixed monthly fee, in the fields and for the number of hours included in the package. Its advantage is that costs are predictable and the pricing is significantly better than for individual matters.

The fees and calculators on this website are for guidance only. The attorney’s fee and the expected costs can only be determined once we know the details of the matter, after which we can give a detailed, final quote.
