For property document drafting – a sale or gift contract, for example – we typically work with a percentage fee based on the purchase price. This cannot be applied in every case, however.
Handling the sale of an empty plot worth a few hundred thousand forints takes the lawyer just as much time as a family house worth over a hundred million paid in one sum.
In the former case our percentage rate would produce a fee of a few thousand forints, which is of course not realistic, so for low-value property transactions we work to a set minimum fee. We set that fee according to the minimum time even the simplest property matter takes, because the work is not confined to drafting the contract.
In the second case, while handling the matter genuinely does not take more hours, the high purchase price means the lawyer’s responsibility is greater – and that has to be reflected in the fee.
It is a misconception that drafting documents is simply routine, and we readily admit we would like to change that mistaken picture. Many underestimate the lawyer’s work here, because preparing the contract is only one part of the whole process.
There is no such thing as routine work– every case has its own particularities. We do not handle clients on a conveyor belt. We aim to answer every question in detail and, perhaps more importantly, in language the client can understand.
From the experience of several hundred property transactions we can say that concluding the contract must in every case include the following:
Besides the value of the matter and the time spent, the particularities of the transaction can also affect the drafting fee. For example, it also matters whether
That is precisely why the calculator above is for guidance only as towhat the fee for a contract will be. We always examine the particularities of the transaction together with the client. Once we know the details, we give a detailed quote covering both the fee and the expected costs. And we always optimise the transfer duty (illeték) at no additional charge.
Real estate law is one of our firm’s main practice areas, so if you want your property matter in safe hands, request a bespoke quote or book a consultation.
Up to a purchase price of HUF 100 million, Dr. Andirkó Law Firm’s fee is 0.5% + VAT (minimum HUF 150,000 + VAT); between HUF 100 and 200 million, 0.4% + VAT; between HUF 200 and 300 million, 0.3% + VAT; above HUF 300 million, a fixed HUF 1,000,000 + VAT. Other factors (a preliminary contract, more complex clearing of encumbrances, official licensing procedures, and so on) can affect the fee, so we can only give a precise quote once we know the full facts.
The amount shown by the calculator includes the gross attorney’s fee together with the VAT-exempt official charges (the land registry procedural fee, for example), so the total expected outlay is visible in one figure.
You can indicate this with a separate checkbox in the calculator, because payment in instalments tied to a loan or state support can affect the complexity of the contract and therefore the fee.
The calculator lets you enter the number of properties, because the fee is adjusted where several properties are sold in one transaction.
No – the firm always optimises the transfer duty (illeték) at no additional charge.
The calculator is for guidance only and is not an offer. The firm gives the final quote, tailored to the particularities of the matter, once it knows the details.
No. Under point 10.6/B f) of the Hungarian Bar Association’s rules on the ethics of the legal profession (6/2018. (III. 26.) MÜK), the engagement contract may not depart, to the client’s disadvantage, from the fee information published on the website.
